Requirements for Social Security disability
The attorneys at The Law Offices of Craig L. Cook want to help you understand the requirements for filing for Social Security disability. Though many people immediately think about the medical aspects, there are also a variety of non-medical requirements that you must meet to qualify for SSDI benefits.
- Medical requirements. First, your injury or condition must be severe enough to keep you from being able to work. Each type of injury has different standards of severity. There is quite a bit of documentation for common conditions associated with the heart, back, kidneys and liver, and also for conditions such as cancer, brain disorders, immune diseases and any emotional or mental illnesses. Some other common conditions, however, such as ADHD, diabetes and migraines, do not have such documentation. You and your attorney must argue for the severity of your condition, with the usual approach being to combine the condition’s seriousness with an argument for deficiency in an area such as age, education, work skills or other restrictions.
- Non-medical requirements. You cannot engage in any form of substantial work while on Social Security disability. There is a monthly dollar limit for earnings, and that amount depends on a variety of factors as judged by the agency. Additionally, you must have paid enough money into the system to qualify for SSDI.
Our attorneys simplify these requirements for you and answer any other questions that you might have about your eligibility.
